1. Acceptance of Terms
By accessing or using the BeTogether application ("App") or receiving SMS messages from BeTogether, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App or its services.
2. Description of Service
BeTogether is a family and community engagement platform that helps participants ("Collectors") connect with their support network through shared activities, quests, and guided experiences. Program staff or family members ("Guides") facilitate the experience by creating quests, monitoring progress, and providing encouragement.
3. Eligibility
BeTogether is intended for use by participants enrolled in a supported program or family unit, along with their designated guides. Access is managed through invite codes provided by program administrators.
4. User Accounts
- Accounts are created through an invite code and a chosen display name.
- You are responsible for maintaining the security of your account credentials.
- You agree to provide accurate information during account setup.
5. Acceptable Use
You agree to use BeTogether only for its intended purpose. You agree not to:
- Use the App for any unlawful purpose
- Attempt to access accounts or data belonging to other users
- Interfere with or disrupt the operation of the App
- Reverse engineer, decompile, or attempt to extract the source code of the App
6. SMS Messaging Terms
BeTogether may send SMS messages to participants who have been enrolled in SMS notifications by their guide.
- Consent: By participating in the BeTogether program with SMS notifications enabled, you consent to receive text messages from BeTogether related to quest notifications and engagement check-ins.
- Frequency: Message frequency varies. SMS is used sparingly for time-sensitive notifications and occasional check-ins. Typical usage is a few messages per week at most.
- Opt-out: Reply STOP to any BeTogether SMS message to stop receiving messages. You will receive a confirmation of your opt-out. No further messages will be sent unless you re-enroll.
- Help: Reply HELP to any message for support contact information.
- Costs: Message and data rates may apply. BeTogether is not responsible for any charges incurred from your mobile carrier.
- Carriers: SMS messages are delivered through standard mobile carriers. BeTogether is not responsible for delayed or undelivered messages due to carrier issues.
- No mobile information sharing: We will not sell, rent, or share your phone number or SMS data with third parties for their marketing purposes.
7. Intellectual Property
All content, features, and functionality of the BeTogether App — including but not limited to text, graphics, logos, and software — are the property of BeTogether and are protected by applicable intellectual property laws.
8. Privacy
Your use of BeTogether is also governed by our Privacy Policy. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.
9. Disclaimer of Warranties
BeTogether is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
10. Limitation of Liability
To the maximum extent permitted by law, BeTogether and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App or SMS services.
11. Modifications to Service
We reserve the right to modify, suspend, or discontinue any part of the BeTogether service at any time, with or without notice.
12. Changes to Terms
We may update these Terms from time to time. Continued use of the App or SMS services after changes constitutes acceptance of the revised Terms. We will notify users of significant changes through the App.
13. Termination
We reserve the right to suspend or terminate your access to BeTogether at our discretion, including for violation of these Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.
